WE'RE GENERALLY KNOWN AS THE COUNTY'S LARGEST HOME OWNERSHIP ASSISTANCE AGENCY.

SO WE DO COMPREHENSIVE SERVICES SUCH AS HOME OWNERSHIP TRAINING.

WE OFFER, UH, AFFORDABLE, UM, LENDING.

UM, AND I'LL GO THROUGH THOSE.

WELL, SO YEAH, HERE ARE OUR SERVICES, FINANCIAL EDUCATION, AFFORDABLE LENDING.

WE HAVE A CONSTRUCTION PROJECT MANAGEMENT, UH, GROUP AND MISSION DRIVEN, UH, REAL ESTATE NEIGHBORHOOD REVITALIZATION.

AND WE HAVE A LEGACY PROJECT, WHICH IS A COMPREHENSIVE GENERATIONAL WEALTH, UH, PROGRAM.

UM, AND, UM, WE'VE CREATED, UM, UH, 58,000 JOBS.

AND HERE'S, UH, THE AFFORDABLE LENDING, UH, PROGRAMS. UH, IT'S AFFORDABLE FINANCING, UM, HOME PURCHASE, WHICH WILL HOPEFULLY PICK UP WITH THE INTEREST RATES, UH, GOING DOWN DON'T MOVE IMPROVE, WHICH IS, UH, UH, HOME REHABILITATION PROGRAM.

AND WE OFFER, UM, FINANCING FOR A DS AS WELL, WHICH I KNOW ARE POPULAR HERE IN LONG BEACH.

HERE'S, UM, OUR CLIENT PROFILE FROM THE PAST FISCAL YEAR.

UM, THE MAJORITY OF OUR CLIENTS HAVE BEEN LATINO AT 42%.

UM, AFRICAN AMERICAN CLIENTS AT 36 ASIAN AMERICAN AT 13.

UH, THE LARGEST AGE GROUP IS, UH, 30 TO 44 AT 41%, AND WE HAVE 62% FEMALE CLIENTS IN 72% OF OUR CLIENTS ARE 8% OR BELOW THE 80, UH, AREA, 80 INCOME.

THE NEXT SLIDE IS A CLIENT PROFILE FROM HERE IN, IN LONG BEACH.

SO OUR CLIENT ATTENDED THE HOPE, OUR HOPE WORKSHOP, AND OUR FAST TRACK COURSE, WHICH IS A HUD APPROVED EIGHT HOUR, UM, HOME OWNERSHIP TRAINING COURSE, WHICH GIVES YOU ACCESS TO THE DOWN PAYMENT ASSISTANCE, UH, THE PURCHASE PRICE, WHICH IS GREAT IN SOUTHERN CALIFORNIA WITH $675,000.

THE CLIENT DOWN PAYMENT WAS ABOUT 3% OF THE PURCHASE PRICE, WHICH WAS WELL OVER $20,000.

THE CLIENT RECEIVED $25,000 IN DOWN PAYMENT ASSISTANCE FROM THE CITY OF LONG BEACH.

UM, AND THE CLIENT WAS ABLE TO ACCESS THE GREEN LIGHT HOME PROGRAM GRANT PROGRAM, WHICH WE MANAGED FOR THE COUNTY OF LOS ANGELES.

AND THAT IS AROUND, THAT WAS AROUND 35, UH, THOUSAND DOLLARS.

AND, UH, YEAH, THIS IS OUR CONTACT INFORMATION.

UM, SO QUESTION, WHEN IT COMES TO THE SERVICES THAT YOU ALL PROVIDE, AND IT LOOKS LIKE FROM YOUR CLIENT PROFILE, YOU, YOU WORK IN THE CITY OF LONG BEACH.

HOW DO PEOPLE APPLY FOR YOUR SERVICES? WELL, IT, INITIALLY IT'S JUST FOLKS, IT, PART OF IT IS ON OUR END, UM, DOING OUTREACH, MAKING SURE THAT PEOPLE KNOW ABOUT THE PROGRAMS THAT WE OFFER.

UM, WE ALSO TRY TO ENGAGE MUNICIPAL GOVERNMENTS LIKE THE CITY, LONG BEACH,

UM, A LOT OF PEOPLE ARE REALLY INTERESTED IN ADUS THESE DAYS, OR IT COULD BE, UM, ASSISTANCE TOWARDS HOME OWNERSHIP, WHICH WE HOPE WILL PICK UP WITH THE INTEREST RATES.

SO IT'S REALLY, YOU KNOW, TRYING TO CATCH PEOPLE WHEREVER THEY COME, WHEREVER THEY ARE, UM, AND MAKING THEM AWARE OF OUR SERVICES.

LONG BEACH IS GETTING SERVED, BUT THE STRATEGY WOULD BE TO BE MORE DIRECT AND DO A LOT MORE OUTREACH IN LONG BEACH TO LONG BEACH FAMILIES AND CLIENTS THAT NEED US, AND THEN HAVE LOCATION SPACE WHERE WE CAN BE OPERATING AND REALLY ASSIST IN A DIRECT WAY THAT HELPS EVERYONE.

THOSE THINGS CAN BE LAYERED.

BECAUSE I THINK A LOT OF TIMES PEOPLE THINK ABOUT MAYBE SOME OF THE A DU WORK WE ARE DOING IN THE ASSISTANCE WITH THAT, OR THE HOME OWNERSHIP DOWN, YOU KNOW, THE FIRST TIME HOME BUYER PROGRAM, THE DOWN PAYMENT ASSISTANCE.

I THINK A LOT OF TIMES PEOPLE FEEL LIKE I HAVE TO CHOOSE A BUCKET AS OPPOSED TO I CAN ACCESS ALL OF THESE AND LAYERING THEM TOGETHER, WHICH I THINK IS REALLY BENEFICIAL.

CAN YOU TALK A LITTLE BIT TO THAT? YEAH.

SO OUR PROGRAMS ARE NON-EXCLUSIVE.

SO SOME OF OUR MOST SUCCESSFUL, UM, PARTICIPANTS IN OUR HOME BUYER DOWN PAYMENT PROGRAM HAVE LAYERED STATE MONEY WITH THE CITY MONEY IN ORDER TO BE ABLE TO, TO ACHIEVE THEIR DREAM OF HOME OWNERSHIP.

SO, UM, WE'RE ALWAYS GLAD TO, TO WORK WITH NEW PARTNERS AND, AND MAKE THAT, UM, A REALITY.

I THINK, UM, OUR A DU PROGRAM, WE HAVE MUCH MORE DEMAND THAN WE HAVE SUPPLY, SO WE'D LOVE TO, YOU KNOW, UH, HAVE PARTNERS AND TALK ABOUT MORE SUSTAINABLY, YOU KNOW, FUNDING THAT PROGRAM.

BUT, UM, FOR THE PUBLIC THAT MAY BE LISTENING, YOU CAN ALWAYS, UM, COMBINE MULTIPLE FUNDING SOURCES.

UM, AND THERE ARE, YOU KNOW, A NEW CONSTRUCTION.

SOMETIMES THERE'S A CREDIT FROM THE, THE BUILDER, AND THEN YOU COULD USE OUR PROGRAM AND A A PROGRAM FROM ANOTHER AGENCY.

AND THAT'S COMPLETELY PERMISSIBLE, UM, AT LEAST UNDER OUR RULES AND MOST LENDERS RULES.

SO, UM, YOU KNOW, THINGS ARE VERY EXPENSIVE.

SO WHATEVER IT TAKES IN TERMS OF THAT LAYERING TO MAKE IT WORK, I THINK IS, IS THE RIGHT APPROACH.

SO THAT RANGE, YOU KNOW, YOU TRY TO BE AVAILABLE.

SO WE'RE DOING BOTH.

AND I THINK IF THEY'RE, UH, WE TRY TO ASSESS DEMAND.

I WOULDN'T WANT A TEAM MEMBER TO COME OVER FROM COMPTON WHERE WE HAVE A FACILITY FOR TWO PEOPLE.

COULD YOU TALK A LITTLE BIT ABOUT THE LEGACY PROGRAM? I KNOW GERALD MENTIONED IT, BUT I THINK WE DON'T OFTEN HEAR, PARTICULARLY IN COMMUNITIES OF COLOR, A LOT OF, UH, CONVERSATIONS AROUND WEALTH BUILDING GENERATIONAL WEALTH.

RIGHT.

WHICH I THINK IS SOMETHING THAT'S REALLY UNIQUE ABOUT YOUR PROGRAM, AND I'D LOVE TO YOU TO SHARE A LITTLE BIT ABOUT THAT.

YEAH.

THE LEGACY PROJECT IS A 10-YEAR-OLD CONCEPT.

UM, I HAVE THESE IDEAS, MOST OF 'EM GET THROWN ON THE FLOOR.

AND THEN THERE'S WHAT CAN WE ACTIVATE? AND I THINK COUNCILMAN, SINCE I'VE SEEN YOU, WE'VE REALLY TAKEN OFF WITH THE LEGACY PROGRAMMING.

AND ONE OF MY DREAMS WAS ALWAYS TO HAVE PEOPLE LIKE THE CRADLE TO GRAVE CONVERSATION, EVEN THOUGH THAT SOUNDS A LITTLE MORBID, BUT YOUR WHOLE LIFETIME.

AND IT'S HOW DO WE ENGAGE WITH PEOPLE IN THAT WAY? AND THEN COVID HIT, SO WE SLOWED DOWN SOME, BUT WHAT WE KEPT SEEING IS THAT PEOPLE GET ALL THE WAY TOWARD THEIR END, WHATEVER THAT IS, AND THEY MAY HAVE A HOUSE FREE AND CLEAR.

THAT'S 30% OF OUR CUSTOMER BASE, AND WE HAVE SIX, 7,000 PEOPLE A YEAR.

WE'RE TALKING TO A THIRD OF THEM.

BEING FREE AND CLEAR ON THEIR PROPERTIES IS DANGEROUS IN THE SCHEME OF THE REAL ESTATE WORLD BECAUSE PEOPLE ARE HUSTLING THEM, RIGHT.

TRYING TO GET THEM TO GIVE UP THAT PROPERTY.

AND THEY'RE NOT THINKING LEGACY AND THINKING, I'VE OWNED THIS FOR 40, 50 YEARS.

'CAUSE WHEN THEY TALK TO THEIR FAMILY MEMBERS, THE FAMILY MEMBERS DON'T HAVE THE FINANCIAL WHEREWITHAL TO TAKE OVER THE HOUSE.

SO MANY OF OUR SENIORS ARE TAKING OUT REVERSE MORTGAGES, WHICH WE DON'T LIKE.

AND I STAY IN TROUBLE WITH HUD ON THAT, BUT I'VE TOLD HIM, YOU GUYS GOTTA RELAX THAT THING, RIGHT? AND YOU CAN'T HAVE A SENIOR PAYING 18% INTEREST THAT'S NOT DUE AND PAYABLE TILL THEY PASS AWAY.

'CAUSE WHEN THEY DO PASS ON, THEIR FAMILY CAN'T PAY FOR IT AND THE HOUSE IS LOST.

THAT'S JUST ONE EXAMPLE.

THERE ARE 50.

AND SO I THINK OUR JOB, IF WE'RE GONNA SAY WE'RE IN THE FINANCIAL EDUCATION BUSINESS, IS TO MAKE SURE PEOPLE KNOW ALL THE WAY THROUGH THEIR LIFETIME HOW THEY CAN ACCESS CERTAIN RESOURCES.

SO WE'VE NOW ADDED IN THE LAST YEAR A NUMBER OF ESTATE PLANNING ATTORNEYS.

AND IT HAS BEEN A REMARKABLE PROCESS.

VERY HARD.

I'LL TELL YOU THAT AS A SEASONED PROGRAMMING PROFESSIONAL KIND OF THING, WE'RE ALL TECHNICAL, BUT THE LAWYERS BRING A WHOLE NOTHER LEVEL OF KICK.

AND THIS IS HOW IT HAS TO BE.

AND OUR FAMILIES OF COLOR DON'T WANNA TALK ABOUT DEATH.

THEY DON'T WANT TO TALK ABOUT THE LONG HAUL.

THEY DON'T.

THESE ARE THINGS THAT ARE UNCOMFORTABLE FOR PEOPLE.

AND SHE SAID, AND WE'VE STUDIED IT AS ESTATE PLANNERS, THAT CHANGES EVEN WITH RICH PEOPLE OF COLOR BECAUSE THERE'S THIS NOTION THAT IT'S NOT OKAY TO WITHHOLD OR WITHDRAW FROM YOUR CHILD IN ANY WAY.

SHE SAID, BUT IT'S NOT TRUE.

MAP OUT THE PLAN, WRITE THAT VISION DOWN, AND THEN YOUR CHILDREN HAVE A PATH OF ACHIEVEMENT.

AND THEY CAN CHOOSE NOT TO FOLLOW THAT, BUT AT LEAST THEY KNOW WHAT'S REQUIRED IF THEY WANT TO INHERIT WHAT YOU HAVE WORKED SO HARD TO ATTAIN.

AND THAT WAS LIFE CHANGING FOR ME TO HEAR IT THAT WAY, BECAUSE PARTICULARLY IN BLACK CULTURE, IT'S, IT'S NEVER SEEN AS APPROPRIATE TO TALK ABOUT OUR MONEY WITH OUR CHILDREN.

MY KIDS KNOW EVERY DIME I MAKE, THEY KNOW HOW I'VE BEEN SPENDING IT.

THEY CHECK ME WHEN THEY THINK I'M GOING PAST THE BOUNDARIES I'VE SET.

THIS IS HELPFUL.

IN THIS PRESENTATION, I'LL GIVE AN OVERVIEW OF THE JUST CAUSE FOR TERMINATION OF TENANCY'S ORDINANCE AND AN UPDATE ON COMMUNITY ENGAGEMENT EFFORTS.

THE JUST CAUSE FOR TERMINATION OF TENANCY'S ORDINANCE OR JUST CAUSE ORDINANCE FOR SHORT IS THE CITY'S TENANT PROTECTION POLICY MODELED AFTER THE CALIFORNIA TENANT PROTECTION ACT OF 2019.

IT WAS ADOPTED IN 2020 AND OUTLINES THE SPECIFIC REASONS UNDER WHICH A RESIDENTIAL TENANCY OR LEASE CAN BE LEGALLY TERMINATED.

THE POLICY WAS UPDATED IN MAY IN RESPONSE TO SB 5 67, PROVIDING CLEAR GUIDELINES ON OWNER MOVE-IN AND SUBSTANTIAL REMODEL EVICTIONS, SUCH AS

PROHIBITION OF AN OWNER MOVE IN EVICTION.

IF A SIMILAR UNIT ON THE PROPERTY IS VACANT, A TENANT'S RIGHT TO RETURN TO THE UNIT IF CONDITIONS OF AN OWNER MOVE IN OR A SUBSTANTIAL REMODEL EVICTION ARE UNMET.

AND PROVIDING THAT A TENANT IS NOT REQUIRED TO VACATE A PROPERTY BEING REMODELED ON ANY DAYS WHERE THEY COULD CONTINUE LIVING IN THIS SPACE WITHOUT VIOLATING HEALTH SAFETY AND HABITABILITY CODES AND LAWS UNDER JUST CAUSE.

AFTER A TENANT HAS CONTINUOUSLY AND LAWFULLY OCCUPIED A RESIDENTIAL REAL PROPERTY FOR 12 MONTHS, THE PROPERTY OWNER CAN ONLY TERMINATE A TENANCY FOR A SPECIFIC REASON.

THESE REASONS FALL INTO TWO CATEGORIES.

THE FIRST CATEGORY BEING WHEN THE TENANT IS AT FAULT OR AT FAULT, JUST CAUSES, FOR EXAMPLE, WHEN THERE IS A DEFAULT IN THE PAYMENT OF RENT, A VIOLATION OF THE LEASE OR CRIMINAL ACTIVITY BY THE TENANT ON THE PROPERTY.

THE SECOND CATEGORY INCLUDES REASONS FOR EVICTION THAT ARE NOT THE TENANT'S FAULT, WHICH ARE CALLED NO FAULT JUST CAUSES.

THESE INCLUDE THE FOLLOWING, THE INTENT TO OCCUPY THE PROPERTY BY THE OWNER, DOMESTIC PARTNER, OR DIRECT RELATIVE AS SPECIFIED IN THE ORDINANCE AS THAT PERSON'S PRIMARY RESIDENCE.

REMOVING THE PROPERTY FROM THE RENTAL MARKET, FOR EXAMPLE, TO CONVERT THE PROPERTY TO A DIFFERENT USE, THE OWNER COMPLYING WITH A GOVERNMENT ISSUED ORDER AND THE INTENT TO DEMOLISH OR SUBSTANTIALLY REMODEL THE PROPERTY.

CURRENTLY WHEN A PROPERTY OWNER TERMINATES A TENANCY FOR A SUBSTANTIAL REMODEL, THE TENANT MUST BE PROVIDED RELOCATION ASSISTANCE IN THE AMOUNT OF $4,500 OR TWO MONTHS RENT.

WHICHEVER IS GREATER FOR ALL OTHER NO FAULT JUST CAUSES THE AMOUNT IS EQUAL TO ONE MONTH'S RENT, AND THE RELOCATION ASSISTANCE MUST BE PROVIDED WITHIN 15 DAYS OF SERVICE OF THE TERMINATION NOTICE.

NEXT, I'LL TALK ABOUT SUBSTANTIAL REMODEL TENANCY TERMINATIONS.

SUBSTANTIAL REMODEL REFERS TO WORK THAT CAN'T BE DONE SAFELY WITH THE TENANT STILL LIVING IN THIS SPACE AND REQUIRES THEM TO VACATE FOR AT LEAST 30 CONSECUTIVE DAYS.

THIS INCLUDES EITHER REPLACING OR SIGNIFICANTLY ALTERING STRUCTURAL ELECTRICAL, PLUMBING, OR MECHANICAL SYSTEMS THAT NEED A PERMIT OR REMOVING HAZARDOUS MATERIALS LIKE LEAD, PAINT, MOLD, OR ASBESTOS IN ACCORDANCE WITH THE LAW.

AS I MENTIONED EARLIER, A TENANT IS NOT REQUIRED TO VACATE ON ANY DAYS WHERE THEY COULD SAFELY CONTINUE LIVING IN THE UNIT.

BEFORE AN OWNER ISSUES A NOTICE TO TERMINATE A TENANCY FOR SUBSTANTIAL REMODEL OR DEMOLITION, THE OWNER SHALL HAVE OBTAINED ALL NECESSARY PERMITS FOR THE WORK.

IF THE WORK IS NOT COMPLETED, THE OWNER MUST OFFER THE TENANT THE OPPORTUNITY TO RE-RENT THE UNIT UNDER THE PREVIOUS RENTAL AGREEMENT TERMS. THIS JUST CAUSE DOES NOT PREVENT THE OWNER FROM TEMPORARILY RELOCATING THE TENANT TO CONDUCT NECESSARY REMODEL WORK.

CERTAIN TYPES OF PROPERTIES ARE EXEMPT FROM THE JUST CAUSE ORDINANCE, INCLUDING OWNER OCCUPIED SHARED HOUSING, SINGLE FAMILY OWNER OCCUPIED RESIDENCES, INCLUDING A RESIDENCE IN WHICH THE OWNER OCCUPANT RENTS OR LEASES.

NO MORE THAN TWO UNITS OR BEDROOMS, INCLUDING BUT NOT LIMITED TO AN ACCESSORY DWELLING UNIT OR A JUNIOR A DU OWNER OCCUPIED DUPLEXES HOUSING THAT HAS BEEN ISSUED A CERTIFICATE OF OCCUPANCY WITHIN THE PREVIOUS 15 YEARS, AND CONDOS AND SINGLE FAMILY HOMES.

AS LONG AS THE OWNER IS NOT A REAL ESTATE INVESTMENT TRUST A CORPORATION OR AN LLC IN 2020, COUNCIL DIRECTED STAFF TO TRACK SUBSTANTIAL REMODEL JUST CAUSE EVICTIONS.

OVER THE PAST YEAR AND A HALF, THE CITY HAS RECEIVED TERMINATION NOTICES FOR THE DISPLACEMENT OF AT LEAST 145 TENANTS FROM WHAT WE CAN SEE WITH 45% OF THESE FILINGS OCCURRING IN THE DOWNTOWN AREA.

TO SUMMARIZE THE COMMENTS, THERE'S BEEN BROAD TENANT SUPPORT FOR ELIMINATION OF THE SUBSTANTIAL REMODEL JUST CAUSE ALTOGETHER RIGHT OF FIRST RETURN AFTER SUBSTANTIAL REMODELS UNIVERSAL JUST CAUSE ACCUMULATION OF TWO TO THREE MONTHS OF FAIR MARKET RENT DEBT BEFORE ALLOWABLE EVICTION AND RAISING THE RELOCATION ASSISTANCE AMOUNTS.

PROPERTY OWNER CONCERNS INCLUDE THE ABILITY TO SUBSTANTIALLY REMODEL UNITS WHEN NEEDED, ESPECIALLY WITH AGING BUILDINGS, KEEPING THE 12 MONTH WAITING PERIOD FOR PROTECTIONS TO APPLY AND RA AND THAT RAISING RELOCATION ASSISTANCE AMOUNTS WOULD INCREASE SUBSTANTIAL REMODEL COSTS.

IN ORDER TO KEEP LONG BEACH RESIDENTS HOUSED, WE NEED TO FOCUS ON PREVENTION, STRENGTHENING THE JUST CAUSE ORDINANCE WILL DO JUST THAT.

WE NEED THE FOLLOWING APPLY JUST CAUSE EVICTIONS PROTECTIONS IMMEDIATELY AT THE START OF THE LEASE, ELIMINATE SUBSTANTIAL REMODEL AND CLOSE THE LOOPHOLE.

FOR O OWNER MOVE IN.

I SAW THE NAME, I SAW THE NUMBER UP ON THE SCREEN OF 145 TENANTS THAT HAVE BEEN EVICTED DUE TO SUBSTANTIAL REMODEL, IF I UNDERSTOOD IT CORRECTLY, WHAT DOES 145 MEAN IN TERMS OF PERCENTAGE? OF ALL THE TENANTS THAT WE HAVE IN LONG BEACH, TWO THIRDS OF THE LONG BEACH COMMUNITY ARE TENANTS.

SO 145 TENANTS OUT OF TWO THIRDS OF THE POPULATION OF LONG BEACH SEEMS LIKE A VERY, VERY LOW NUMBER.

IT WAS ALSO MENTIONED THAT WE HAVE VERY OLD HOUSING STOCK IN LONG BEACH, SPECIFICALLY IN THE DOWNTOWN.

YOU KNOW, ABOUT SIX MONTHS AGO, THE STAFF OF COMMUNITY DEVELOPMENT WAS WORKING ON SEISMIC RETROFIT ON A VOLUNTARY PROGRAM TO TRY TO UPGRADE THESE BUILDINGS.

EVENTUALLY THAT'S GOING TO BE A MANDATE SOMEWHERE DOWN THE ROAD THAT'S GONNA BE VERY COSTLY PER UNIT TO A LOT OF THE SENIORS THAT USE THE RENTAL INCOME AS AN INVESTMENT FOR THEIR RETIREMENT.

KEEP THAT IN MIND.

SO IT'S NOT JUST, IT'S NOT JUST SUBSTANTIAL REMODELS, NOT JUST JUST CAUSE EVICTION.

IT'S ALSO SEISMIC RETROFIT, WHICH IS A EVENTUALLY ANOTHER MANDATE COMING.

THERE ARE A NUMBER OF REASONS WHY THAT IS THE CASE, AND I THINK THAT SOME OF THE CHALLENGES THAT, UH, THAT WE HAVE AS HOMEOWNERS IS WE WANT TO WORK WITH THE CITY TO, TO KEEP THE HOUSING STOCK UP, TO TAKE CARE OF OUR TENANTS, TO DO THESE THINGS.

HOWEVER, ESPECIALLY MOM AND POP HOMEOWNERS, WE ARE UNDER PRESSURE FROM THE CITY TO KEEP THE HOUSING STOCK UP, WHICH WE WANT TO DO.

AND AT THE SAME TIME, WE ARE THERE ARE THERE, THERE ARE TIMES THAT ARE THINGS THAT NEED TO BE DONE THAT CAN'T BE DONE WITH TENANTS SAFELY IN PLACE.

AND IF WE ARE ASKED TO ADHERE TO CERTAIN REQUIREMENTS, BUT BUT AREN'T GIVEN THE OPPORTUNITY TO, TO GET INTO THE UNIT AND DO MAKE THE CHANGES THAT WE NEED TO MAKE, THEN IT, IT BECOMES AN UNTENABLE SITUATION.
